The CM has become quiet after I raised his contempt of the Hon’ble Supreme Court: Gaurav Gogoi

Guwahati, Jan 31: Congress MP Gaurav Gogoi on Saturday launched a sharp attack on Assam Chief Minister Himanta Biswa Sarma, accusing him of falsely attributing certain observations to the Supreme Court of India and thereby risking contempt of court.

Gaurav Gogoi alleged that Assam Chief Minister Himanta Biswa Sarma has remained silent after he raised concerns over alleged contempt of the Supreme Court.

In a statement posted on social media, Gogoi alleged that the Chief Minister became “silent” after he raised the issue of contempt, and accused the BJP leadership of relying on rhetoric and selective screenshots. Gogoi asserted that when a court cites a report relied upon by a party, the language of that report does not automatically become the court’s own words. He said attributing such language to the Supreme Court amounted to a “clear case for contempt.”

The remarks come in the backdrop of Sarma’s recent defence of his controversial comments on the term “Miyan,” where the Chief Minister cited Supreme Court observations on illegal migration in Assam. Sarma had said his statements reflected judicial concerns rather than political rhetoric, referring to warnings about demographic change and its implications for Assam’s territorial integrity and national unity.

The Chief Minister quoted from a Supreme Court judgment in a case involving former Assam CM Sarbananda Sonowal, stating that continued illegal migration could alter Assam’s demographic profile and pose long-term risks. “These are the Court’s words, not my imagination,” Sarma had said, adding that acknowledging the issue does not amount to communalism and that his government’s actions are aimed at protecting Assam’s identity and security.

However, Gogoi disputed this claim, alleging that the language cited by Sarma did not originate from the Supreme Court itself but from an executive report referred to during the case. Calling it a “blatant lie,” Gogoi said passing off such material as the apex court’s own words was dishonest and undermined constitutional propriety and institutional integrity.

Gogoi further stated that the Supreme Court may take cognisance of the matter, as falsely invoking the authority of the apex court by a constitutional functionary could amount to contempt.

There was no immediate response from the Assam Chief Minister to Gogoi’s allegations at the time of filing this report.
